Akila K9 Training Terms & Conditions
1.0 General
1.1 All dogs/pets will be subject to an initial assessment by Akila K9 Training prior to commencement of any Day Training/Walking or Boarding service. This will be in the form of a “meet and greet session” with the client and dog(s). Akila K9 Training shall perform all services in an attentive, reliable and caring manner, using all reasonable skill and care.
1.2 Akila K9 Training reserves the right to choose their clients and can turn down bookings if necessary.
1.3 At any time, when appropriate, Akila K9 Training may choose to use their own dog's as 'stooges' to assist training.
1.4 Akila K9 Training may have additional trainers or specialist professionals including vets present as well as spouse, family member or friend accompany them whilst providing the scheduled services. No costs will be incurred by the Client for any assistance the companion provides. All extra person(s) will be subjected to which ever checks Akila K9 Training considers necessary or appropriate.
1.5 Prior to all boarding services, a daily routine will be agreed with the client, including feeding, grooming, exercise and sleeping. Akila K9 Training will endeavour to adhere to the agreed routine, however the client agrees that there may be occasions where this is not possible.
1.6 Clients will be updated regarding walks, day care and boarding services via the Time To Pet portal.
2.0 Behaviour
2.1 The Client agrees to notify Akila K9 Training immediately if their pet has any unwelcome changes of behaviour which could lead to aggression and/or injury to themselves or others. Akila K9 Training reserves the right to refuse any dog/pet deemed in their absolute discretion to be, or have the potential to be, dangerous or disruptive.
3.0 Health history
3.1 It shall be the sole responsibility of the Client to ensure that Akila K9 Training is fully aware of any health issues that your pet is experiencing or has suffered in the past. Akila K9 Training cannot be held liable for any actions or omissions which result in problems or complications for anything not disclosed.
4.0 Extreme Weather
4.1 In the event of extreme weather which may have an adverse effect on the Client’s pet e.g. heat or thunder storms, Akila K9 Training shall in their sole discretion take whatever action they consider necessary, including adjusting arrangements or not carrying out scheduled bookings until it is, in their opinion, safe to do.
5.0 Booking
5.1 No booking can be accepted without an agreement of the Terms & Conditions and an activated & completed Client Account. The Client will be emailed an invitation to activate their account prior to their booking being confirmed.
6.0 Losses & Damages
6.1 The Client agrees that Akila K9 Training is not responsible for any lost, stolen, or damaged pet equipment. Akila K9 Training will use best endeavours to make sure that items are treated respectfully and returned to the Client where applicable.
7.0 Pet Illness/Injury
7.1 The Client agrees to take any necessary measures or precautions to ensure that their pet is continuously free of contagious, infectious, or otherwise communicable diseases. The Client further agrees to notify Akila K9 Training immediately of any infectious and/or contagious disease or conditions their dog has been exposed to or is affected by. Such diseases and conditions include, but are not limited to: Distemper, Hepatitis, Kennel Cough, Parvovirus, Corona virus, worms, Lyme disease, Fleas, Pregnancy, Infectious Skin Diseases and Intestinal Parasites and all other contagious diseases for pets in general. Akila K9 Training reserves the right to refuse any booking until satisfied that the condition is resolved.
7.2 If the Client's pet is taken sick or injured while under the care of Akila K9 Training they will notify the Client at the earliest convenience using whatever method is available to take instructions or guidance. In the event of Akila K9 Training not being able to contact the Client, or in an emergency situation, Akila K9 Training shall seek out medical attention from the nearest vet. Westover Veterinary Practice, North Walsham is the nominated vet for all boarding and day care clients.
7.3 The Client is responsible for the full cost of treatment of any injuries or illness that their pet receives while under the care of Akila K9 Training, together with any associated costs e.g. call-out charges. The Client authorises Akila K9 Training to seek such veterinary advice and/or treatment as they deem necessary, including euthanasia. Euthanasia may only be carried out by a registered vet. In cases of euthanasia, the pet shall be held at the vet practice until such time that he client returns. The Client agrees to pay all such costs immediately.
7.4 The Client shall make Akila K9 Training aware if their dog is in heat. Dogs in heat are not permitted to attend any group training sessions or walks or boarding services. It is at the discretion of Akila K9 Training as to whether 1-2-1 training sessions and solo walks shall continue. Akila K9 Training reserves the right to cancel or re-arrange any pre booked training sessions should you dog come into heat after booking.
8.0 Photography & Videography
8.1 The Client consents, to give permission to use photographs and or videos of their pet for Akila K9 Training to use on their social media and website. If you have special requests such as omission from photos/videos or a change of name on social media platforms, this should be stated upon booking.
9.0 Insurance
9.1 Akila K9 Training is fully insured including Public Liability Insurance relative to the services performed for the Client. It is agreed by the Parties that it is the Client’s responsibility to ensure that the property, its contents, and pets are adequately insured throughout the duration of the agreement. The Client is advised to check to see if their insurance provider need informing that someone will have access to the Client’s property whilst they are away from the property.
10.0 Dog Walking
10.1 The Client agrees to ensure their dog has not eaten in the hour before picking up by Akila K9 Training to ensure sufficient time to digest food before any exercise or play. Failure to do so may result in the potentially life-threatening condition Bloat (Gastric Torsion). Please take this seriously.
10.2 The Client agrees that, in by signing the booking form, Akila K9 Training has relied on the Client’s representation that their dog is in good health and has not harmed or shown aggression or threatening behaviour towards any person, livestock and pets.
10.3 Akila K9 Training offer services including but not limited to 1-2-1 training, day training, day care, solo walks, pet visits, pet taxi, group walks and home boarding. Dogs may co-mingle in groups and the Client accepts that during the course of normal dog play their dog may sustain injuries. All dog play is carefully monitored to avoid injury, but scratches, punctures, torn ligaments, or other injuries may occur despite the best supervision.
10.4 Akila K9 Training will only let dogs off the lead once an ‘off the lead consent’ has been agreed in writing and will remain at the discretion of Akila K9 Training once they feel it is safe and appropriate to do so.
10.5 Akila K9 Training shall follow instruction given by the client but cannot be held liable for any complications which may arise. All dogs being under the care of Akila K9 Training must be fully vaccinated, including kennel cough, and on a regular flea and worm control regime. In the event of a pet having a contagious illness or disease which has not been disclosed, the Client may be liable for the costs of treatment given to other animals which become infected.
10.6 The Client accepts that even though there has been treatment against Kennel Cough there is a chance that their dog can still contract Kennel Cough. The Client agrees that they will not hold Akila K9 Training responsible if their dog contracts Kennel Cough while with Akila K9 Training.
10.7 All dogs will be handed into the care of Akila K9 Training with a suitably fitted collar, tagged with the owner’s details as per UK legislation.
10.8 The Client accepts sole responsibility that the dog/pet is appropriately microchipped with all information correct and up to date.
10.9 Akila K9 Training will endeavour to return dog(s) in a clean manner, however the Client accepts that their dog may get dirty during walks.
11.0 Payment
11.1 The Client agrees to pay Akila K9 Training by online payment via Time To Pet or bank transfer on receipt of invoice and prior to the commencement of their services. A maximum of 24 hours grace will be given for payment to be made on receipt of invoice. Akila K9 Training reserves the right to cancel or refuse any training that has not been paid for in advance.
11.2 Akila K9 Training will charge the Client for the Services as quoted online.
11.3 All 121 training, block bookings, day training, day care and single night boarding require full payment on booking.
11.4 All regular walking clients must ensure that invoices are paid before the first of each month for the month ahead.
11.5 For all home boarding longer than one night and Wedding Day Chaperone Services, a 50% deposit is required on booking to secure the dates. The remaining payment is due two weeks before the services commence. No refund will be given for cancellation less than two weeks before the services commence.
12.0 Cancellations/Refunds
12.1 In the event that Akila K9 Training is unable to fulfil services agreed, either services will be rescheduled or a full refund will be issued within 7 to 10 working days. The Client accepts that Akila K9 Training has no control over the banks processes.
12.2 The Client accepts sole responsibility for informing Akila K9 Training of any services not required or wishing to be rescheduled within a suitable time period of no later than [48] hours notice.
12.3 Any cancellations within [48] hours of scheduled services will receive a 50% refund.
12.4 Any cancellations within [24] hours of scheduled services will receive no refund and the Client accepts sole responsibility for paying for services lost in full. With the exception of illness/injury of the dog/pet in which they cannot be trained. Proof may be required. In this instance it is at the discretion of Akila K9 Training as to whether a refund can be issued. The Client accepts sole responsibility for informing Akila K9 Training as soon as possible. A full refund will be issued. The Client accepts that Akila K9 Training has no control over the bank's processes. All the above is at the discretion of Akila K9 Training.
13.0 Property
13.1 Any damage to the property or possessions of the Client in their absence, caused by the Client’s pet shall be reported to the Client at the earliest opportunity.
13.2 Where it is necessary for Akila K9 Training to hold keys to a property, the Client shall provide one of each key needed. Keys will be coded and kept secure. Keys will be returned upon completion of this agreement providing all fees due have been paid.
13.3 The Client agrees that, by signing the key holder agreement this will safeguard Akila K9 Training in full against any liability arising from loss or damage to the property or its contents, in present and future circumstances.
14.0 Third Parties
14.1 The Client shall advise Akila K9 Training of anyone who will have access to their property during any periods of the Client’s absence, e.g., cleaning services, maintenance personnel, friends, family and neighbours. Akila K9 Training shall not be liable for other persons or their actions or omissions who will be in, or have access to the Client’s property before, during or after services have been rendered.
15.0 Contact Information
15.1 It shall be the Client’s sole responsibility to ensure the information provided is current and up to date for the duration of the contract, the Client agrees to accept any decision made by Akila K9 Training in the event of not being able to contact the Client as a result of wrong information held.
16.0 Privacy Policy
16.1 All of your information will be kept private and confidential and filed accordingly under the General Data Protection Regulation 2018 (GDPR).
17.0 Governing Law & Jurisdiction
17.1 Each of the parties to this Agreement irrevocably agrees that the courts of England shall have exclusive jurisdiction to hear and decide any suit, action or proceedings, and/or to settle any disputes, which may arise out of or in connection with this Agreement or its formation or validity and, for these purposes, each party irrevocably submits to the jurisdiction of the courts of England.
17.2 Any Forbearance, tolerance or delay in either party enforcing its contractual or legal rights shall not prejudice, restrict or prevent the right of the injured party to enforce its rights at a later date or later breach. In the event of the dog/pet receiving any court order the Client agrees to inform Akila K9 Training immediately. Failure to do so may result in termination of the contract. In this instance Akila K9 Training has the right to seek compensation for any losses caused within and up to [28] day period.
18.0 Forced Majeure
18.1 Neither party shall be liable in damages or have the right to terminate this Agreement for any delay or default in performing its obligations under this Agreement caused by conditions beyond its control including but not limited to acts of God, war, strikes, fires, floods, governmental restrictions or power failures. The Party (the “Affected Party”) prevented from carrying out its obligations shall give notice to the other Party of an Event of Force Majeure upon it being foreseen by, or becoming known to, the Affected Party.
19.0 Variation
19.1 No variation of these Terms and Conditions will have effect unless confirmed by Akila K9 Training in writing. We may revise this disclaimer from time-to-time. You will be informed of any changes to the Terms and Conditions.
